a troubling sign for prop 8’s supreme court case

supremeUh oh. California Justice Joyce Kennard has been considered a strong LGBT rights ally on the California Supreme Court, but Kennard was the one justice who denied hearing the cases looking to overturn Prop 8. The LA Times has a recap here, but this quote from the Times’ story wraps things up pretty clearly.:

“It definitely isn’t a good sign,” said UCLA Law Professor Brad Sears, an expert on sexual-orientation law.

    Troubling? Almost every legal expert I’ve read who was asked about the chances of the case before the Supreme Court has answered in definitive terms—whether they believe Prop 8 will be certainly overturned or whether the Court will undoubtedly uphold Prop 8. So I take the quotes from experts with a grain of salt.

    In any case, we need to hope that the Court will overturn the case but we need to work as if it won’t.
